Before placing an order, we suggest you learn about the payment gateway’s policies. Contact the payment gateway or your bank if you need help throughout the payment process; we cannot help.
Dispute Resolution
Complaints & Refunds
NewsTides does not process refunds for third-party transactions. However, we encourage users to report fraudulent sellers. If a dispute arises, we will attempt to assist by directing you to the appropriate third-party vendor’s complaint resolution system.
Informal Negotiations
To resolve any dispute or claim related to these Legal Terms (called a “Dispute” individually and “Disputes” collectively), you and we (referred to as “Party” individually and “Parties” collectively) will first try to negotiate informally for at least thirty (30) days before starting arbitration. This informal negotiation begins when one Party gives written notice to the other Party. This process helps to speed up resolution and manage costs related to any Dispute.
Binding Arbitration
If you have a dispute related to these Legal Terms, including questions about their existence, validity, or ending, it will be settled by the International Commercial Arbitration Court of the European Arbitration Chamber located at Avenue Louise, 146, Brussels, Belgium. This court will follow its own rules, which are included as part of this agreement. There will be three (3) arbitrators. The arbitration will take place in Gurugram, Haryana, India, and the proceedings will be in English. Indian law will govern these Legal Terms.
Restrictions
The Parties agree that arbitration will only address disputes between them. To the fullest extent allowed by law:
(a) No arbitration can be combined with any other proceedings.
(b) Disputes cannot be handled as class actions or use class action procedures.
(c) No disputes can be presented on behalf of the general public or any other individuals in a supposed representative capacity.
Exceptions To Informal Negotiations And Arbitration
The Parties agree that the following types of Disputes will not be handled through informal negotiations or binding arbitration:
(a) Any Disputes that involve enforcing, protecting, or questioning the validity of a Party’s intellectual property rights;
(b) Any Dispute related to allegations of theft, piracy, invasion of privacy, or unauthorized use; and
(c) Any request for injunctive relief.
If a part of this provision is found to be illegal or unenforceable, neither Party will pursue arbitration for Disputes that fall under that portion. Instead, these Disputes will be resolved by a qualified court as mentioned above, and both Parties agree to be subject to that court’s authority.
Consumers in India, the EU, or the US may have the right to bring disputes before their local courts if arbitration is not enforceable under their jurisdiction.
